Compliance Alert: NLRB Posting Print E-mail

The National Labor Relations Board has again delayed the required posting date of its new NLRB posting until April 30, 2012 (the original effective date was postponed). While there have been lawsuits filed objecting to the content of the posting, the NLRB asserts this time is to "allow for further education and outreach" to employers.

The NLRB's web site reports:

"The decision to extend the rollout period followed queries from businesses and trade organizations indicating uncertainty about which businesses fall under the Board's jurisdiction, and was made in the interest of ensuring broad voluntary compliance. No other changes in the rule, or in the form or content of the notice, will be made."

Employers should expect to be required to post this by April 30, 2012. WAWA members were sent the new poster with the recent WAWA NewsLetter.

All employers, regardless of size, are required to post both state and federal workplace posters. Compliance is convenient and inexpensive. Fines and penalties are not!

It is possible the lawsuit filed against the NLRB will be successful and employers may not have to post the NLRB notice. AWB will be watchful of these developments.
